These Terms & Conditions (“Terms”) govern access to and use of TuitionTeacher AI’s website, desktop applications, mobile applications, and related services (collectively, the “Platform”).

By accessing or using TuitionTeacher AI, you agree to be legally bound by these Terms.

If you do not agree, you must not use the Platform.

1. Company Information

TuitionTeacher AI (“Company,” “we,” “us,” or “our”) is an AI-powered educational productivity platform offering features including:

  1. Supervisor AI (computer vision-based monitoring)
  2. Digital Brain (AI-powered learning memory system)
  3. Parent analytics and reporting tools
  4. Productivity tracking and behavioral insights

2. Eligibility

You must:

  1. Be at least 18 years old, OR
  2. Be a minor with verified parental or legal guardian consent

Parents/guardians are fully responsible for minors' use of the Platform.

We reserve the right to suspend or terminate accounts without notice if eligibility requirements are violated.

3. Acceptance of Monitoring & AI Processing

By using TuitionTeacher AI, you expressly acknowledge and agree:

  1. Supervisor AI may access and process live camera input.
  2. Digital Brain may capture screenshots and extract on-screen content.
  3. AI systems will analyze behavioral patterns (e.g., distraction, yawning, inactivity).
  4. Parents may receive supervision and learning reports.
  5. Automated AI decisions may generate productivity scores and analytics.

You voluntarily grant TuitionTeacher AI the right to process such data for service functionality.

If you disable required permissions, certain features may not function.

4. No Professional Advice

TuitionTeacher AI provides educational productivity tools only.

We do NOT provide:

  1. Psychological evaluation
  2. Medical advice
  3. Behavioral diagnosis
  4. Academic certification
  5. Professional counseling

All AI outputs are informational only. You are solely responsible for decisions made based on reports or analytics.

5. User Responsibilities

You agree NOT to:

  1. Use the Platform for unlawful surveillance
  2. Monitor individuals without proper consent
  3. Reverse engineer or decompile the software
  4. Attempt to extract AI models or proprietary algorithms
  5. Circumvent supervision detection systems
  6. Use automation, scraping, or bots
  7. Upload harmful, illegal, or infringing content
  8. Violate privacy rights of others

Violation may result in immediate termination without refund.

6. Intellectual Property Ownership

All rights, title, and interest in:

  1. Supervisor AI systems
  2. Digital Brain architecture
  3. AI models and training systems
  4. Reports and analytics frameworks
  5. Software code
  6. Design and branding

Are exclusively owned by TuitionTeacher AI.

You receive a limited, non-transferable, revocable license to use the Platform.

No ownership rights are transferred to users.

7. Data & Content Rights

You retain ownership of your original content.

However, by using the Platform, you grant TuitionTeacher AI:

  1. A worldwide, non-exclusive, royalty-free license
  2. To process, store, analyze, and improve services
  3. To anonymize and aggregate data for research and product enhancement

We may retain anonymized data indefinitely.

8. Payments & Subscriptions

If applicable:

  1. Subscription fees are billed in advance.
  2. Fees are non-refundable unless required by law.
  3. We may change pricing at any time.
  4. Failure to pay may result in suspension.

You are responsible for taxes applicable in your jurisdiction.

9. Account Termination

We may suspend or terminate your account:

  1. For violation of these Terms
  2. For suspected abuse
  3. For legal or regulatory risk
  4. For security threats
  5. At our sole discretion

We are not liable for losses resulting from termination.

10. Disclaimer of Warranties

To the fullest extent permitted by law:

The Platform is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, express or implied, including:

  1. Merchantability
  2. Fitness for a particular purpose
  3. Non-infringement
  4. Accuracy of AI outputs
  5. Continuous availability
  6. Error-free operation

We do not guarantee:

  1. 100% distraction detection accuracy
  2. 100% AI-generated learning accuracy
  3. Continuous monitoring without interruption
  4. Error-free screenshot extraction

11. Limitation of Liability

To the maximum extent permitted by law:

TuitionTeacher AI, its directors, employees, affiliates, and partners shall NOT be liable for:

  1. Indirect, incidental, consequential, punitive, or special damages
  2. Emotional distress claims
  3. Academic performance outcomes
  4. Parental disciplinary decisions
  5. Loss of data
  6. Device damage
  7. Loss of profits
  8. Third-party content captured via screenshot
  9. Misuse of supervision data

Our total liability shall not exceed the amount paid by you in the preceding 3 months.

If no payment was made, liability is limited to $50 USD.

12. Indemnification

You agree to defend, indemnify, and hold harmless TuitionTeacher AI from any claims, damages, losses, liabilities, costs, or expenses (including attorney fees) arising from:

  1. Your misuse of the Platform
  2. Violation of laws
  3. Violation of these Terms
  4. Claims by third parties related to monitoring
  5. Unauthorized surveillance
  6. Content captured through screenshots
  7. Parental disputes
  8. Educational disputes

This obligation survives termination.

13. Arbitration & No Lawsuit Clause

By using the Platform, you agree:

  1. You waive the right to file a lawsuit in court.
  2. You waive the right to participate in class action lawsuits.
  3. All disputes must be resolved by binding arbitration.
  4. Arbitration shall be confidential.
  5. Arbitration shall take place in [Insert Jurisdiction].

You agree to resolve disputes individually and not as part of any class, consolidated, or representative action.

14. Force Majeure

We are not liable for failure or delay caused by:

  1. Natural disasters
  2. Internet outages
  3. Cloud provider failures
  4. Government actions

  6. War or civil unrest
  7. Power failures

15. Third-Party Services

The Platform may rely on:

  1. Cloud AI providers
  2. Payment processors
  3. Hosting services

We are not responsible for third-party service interruptions.

16. Security Disclaimer

While we implement industry-standard security:

  1. No system is 100% secure
  2. You use the Platform at your own risk
  3. We are not liable for unauthorized access beyond reasonable control

17. Modification of Service

We may:

  1. Modify features
  2. Remove functionality
  3. Update AI systems
  4. Discontinue services

At any time without liability.

18. Governing Law

These Terms shall be governed by the laws of:

United States and India and all supported countries.

Without regard to conflict of law principles.

19. Severability

If any provision is found unenforceable:

  1. The remainder remains valid
  2. The invalid portion shall be replaced with enforceable language reflecting original intent

20. Entire Agreement

These Terms constitute the entire agreement between you and TuitionTeacher AI and supersede prior agreements.

21. Survival Clause

The following survive termination:

  1. Limitation of Liability
  2. Indemnification
  3. Arbitration
  4. Intellectual Property
  5. Data Usage Rights

22. Explicit Consent

By clicking “I Agree” or using the Platform, you acknowledge:

  1. You have read and understood these Terms
  2. You accept binding arbitration
  3. You waive the right to sue
  4. You waive class action rights
  5. You accept AI monitoring functionality
